YOUR USE OF THIS SYSTEM TO SUBMIT AND COMPLETE THIS APPLICATION AND THE ACCOMPANYING PROPOSED TRANSACTIONS WITH OUR COMPANY ARE SUBJECT TO THE FOLLOWING TERMS AND CONDITIONS, KNOWN AS “TERMS OF USE”.  BY PARTICIPATING AND PROCEEDING INTO THE APPLICATION AND ENTERING INFORMATION INTO THE APPLICATION PROCESS CONSTITUTES YOUR ACCEPTANCE OF AND AGREEMENT WITH THE TERMS OF USE REGARDLESS IF THE APPLICATION WAS COMPLETED OR WHETHER ANY TRANSACTIONS WERE COMPLETED THROUGH THIS APPLICATION PROCESS OR THROUGH OTHER CHANNELS, SUCH AS BY PHONE, EMAIL FACSIMILE OR OTHERWISE. IF YOU DO NOT AGREE TO THE TERMS OF USE, YOU MAY NOT USE THIS APPLICATION.

Terms Of Use

Application Ownership

This application is owned and operated by L Alley Loans, Inc. d/b/a Summit Home Lending, which is referred to below as “Summit Lending” or “us” or “Company”.  While we own the application and data therein, we utilize our partner software provider, the ARIVE software system and portal to enter these applications.  ARIVE is the owner of the software processing software, and we at Summit are the sole and singular broker for your potential loan.

Permitted Uses

By participating and engaging in the application process, you agree that:

  1. Any of your use of our system, website and any of this application is subject to and governed by these Terms of Use,
  2. You are at least 18 years old and agree to only access or use this application for your purposes,
  3. You will comply with the Terms of Use on each time each time you access and use this application, and agree to be bound by these Terms of Use on each instance of use,
  4. You agree that the Terms of Use are a legally binding agreement between you and Summit Lending that will be enforceable against you.

You agree that you will not use or attempt to use this application for any purpose other than conducting mortgage related business with Summit Lending as a bona fide client of Summit Lending.  As such, you agree that you will not use or attempt to use this application or any part of this application for any purpose other than seeking mortgage services from Summit Lending, including the following:

  1. You will not engage in any conduct that interferes with or induces a breach of the contractual relationships between Summit Lending and its employees, agents, contractors, or affiliates,
  2. You will not engage in any conduct that is any way unlawful or prohibited, or that is harmful or destructive to anyone or their property,
  3. You will not engage in any conduct that transmits any advertisements, solicitations, schemes, spam, flooding, or other unsolicited email, unsolicited commercial communications,
  4. You will not engage in any behavior or conduct that transmits any harmful or disabling computer codes or viruses,
  5. You will not engage in any conduct that harvests email addresses from this application,
  6. You will not engage in any conduct that transmits unsolicited Email to this application,
  7. You will not engage in any conduct that interferes with our network services;
  8. You will not engage in any conduct that attempts to gain unauthorized access to our network services or our partners’ or representatives’ network services,
  9. You will not engage in any conduct that suggests an express or implied affiliation with Summit Lending (without the express written permission of Summit Lending),
  10. You will not engage in any conduct that impairs or limits our ability to operate this application or any other person’s ability to access and use this application, and/or
  11. You will not engage in any conduct that unlawfully impersonates or otherwise misrepresents your affiliation with any person or entity;
  12. You will not engage in any conduct that harms minors in any way, including, but not limited to, transmitting or uploading content that violates child pornography laws, child sexual exploitation laws and laws prohibiting the depiction of minors engaged in sexual conduct;
  13. You will not engage in any conduct that transmits or uploads pornographic, violent, obscene, sexually explicit, discriminatory, hateful, threatening, abusive, defamatory, offensive, harassing, or otherwise objectionable content or images;
  14. You will note engage in any conduct that harms, threatens, harasses, abuses or intimidates another person in any way or involves images or content that depicts, promotes, encourages, indicates, advocates or tends to incite the commission of a crime or other unlawful activities;
  15. You will not engage in any conduct that dilutes or depreciates the name and reputation of Summit Lending or any of its affiliates;
  16. You will not engage in any conduct that transmits or uploads any content or images that infringes any third party’s intellectual property rights or infringes any third party’s right of privacy; or
  17. You will not engage in any conduct that unlawfully transmits or uploads any confidential, proprietary or trade secret information.

Access To This Application

Summit Lending reserves the right at all times, in its sole discretion and without notice to you, to deny your access to and use of this application.

Use Of This Application

You agree and acknowledge that you have the sole responsibility and liability for your use of this application and for providing or obtaining, and for maintaining, all of the hardware, software,
